Kids Alive International (KAI) values all of its supporters, staff, volunteers and anyone who comes into contact with us, and we are committed to being open, honest and lawful in the way that we process personal data. We will only store your information if we have a lawful basis for doing so and we will never use anyone’s personal details in any way that they would not reasonably expect. 

This statement outlines the different types of personal data that we collect, how and why we process that data, and who you can contact if you have any questions about the data we hold or the ways in which we process it.

4.1 General

Your right of access - You have the right to ask us for copies of your personal information. You can request other information such as details about where we get personal information from and who we share personal information with. There are some exemptions which means you may not receive all the information you ask for.

  • Your right to rectification - You have the right to ask us to correct or delete personal information you think is inaccurate or incomplete.
  • Your right to erasure - You have the right to ask us to delete your personal information.
  • Your right to restriction of processing - You have the right to ask us to limit how we can use your personal information.
  • Your right to object to processing - You have the right to object to the processing of your personal data.
  • Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you.

4.2 Your right to withdraw consent – When we use consent as our lawful basis you have the right to withdraw your consent at any time.

5. Our lawful bases for the collection and use of your data

5.1 Our lawful bases for collecting or using personal information to receive donations or funding and organise fundraising activities; and/or for service updates and marketing purposes; and/or to comply with legal requirements; and/ or for dealing with queries, complaints or claims are:

Consent - we have permission from you after we gave you all the relevant information. All of your data protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time.

Legal obligation – we have to collect or use your information so we can comply with the law. All of your data protection rights may apply, except the right to erasure, the right to object and the right to data portability.

5.2 Public task – we have to collect or use your information to carry out a task laid down in law, which the law intends to be performed by an organisation such as ours. All of your data protection rights may apply, except the right to erasure and the right to portability.

6. Where we get personal information from

6.1 How long we keep information

Generally speaking, we keep information about you for a period of seven years since your last engagement with us, eg making a donation or signing a petition on our behalf. 

Please note, if you have made a donation and given us permission to collect Gift Aid, we are legally obliged to keep your donation data for at least six years since the donation was made.

6.2 Who we share information with

i. Direct mail data processor and telephone agency

We occasionally send letters to our supporters updating them about our work. If so, we would typically use a trusted third party to do this work for us, such as printing the letters and overlaying our supporter’s details on the letter, eg name and address.  

We may also occasionally ask an agency to contact our supporters by telephone, eg to conduct market research or to ask them to make a donation. 

ii. Our systems consultant

Kids Alive International uses an established charity software system to store and process our supporter details. We also use a trusted consultant to help us operate and update the system, who in turn has access to our supporters’ data, although it is highly unlikely to process it except to help investigate a query. 

iii. Facebook

We participate in Facebook’s Custom Audience and Lookalike Audience programmes, which enable us to display our content to our existing or potential supporters on Facebook. We provide personal information such as your email address or phone number to Facebook which securely encrypts it. That personal information is then deleted by Facebook if it does not match with a Facebook account or once they confirm you have an account.

Appendix – our Privacy and Cookie Policy for our website and online activities

We understand that your privacy is important to you and that you care about how your personal data is used and shared online. We respect and value the privacy of everyone who visits our website, www.kidsalive.co.uk ("Our Site") and will only collect and use personal data in ways that are described here, and in a manner that is consistent with Our obligations and your rights under the law.

D.2 Our use of your personal data will always have a lawful basis, either because it is necessary for Our performance of a contract with you, because you have consented to Our use of your personal data (e.g. by subscribing to emails), or because it is in Our legitimate interests. Specifically, We may use your data for the following purposes:

  • Providing and managing your Account;
  • Providing and managing your access to Our Site;
  • Personalising and tailoring your experience on Our Site;
  • Supplying Our products or services to you (please note that We require your personal data in order to enter into a contract with you);
  • Personalising and tailoring Our products or services for you;
  • Replying to emails from you;
  • Supplying you with emails that you have opted into (you may unsubscribe or opt-out at any time by following the unsubscribe link in any of these emails);
  • Market research;
  • Analysing your use of Our Site and gathering feedback to enable Us to continually improve Our Site and your user experience.

D.3 With your permission and/or where permitted by law, We may also use your data for marketing purposes which may include contacting you by email, telephone, text message or post with information, news and offers on Our products and services. We will not, however, send you any unsolicited marketing or spam and will take all reasonable steps to ensure that We fully protect your rights and comply with Our obligations under the GDPR and the Privacy and Electronic Communications (EC Directive) Regulations 2003.

D.4 Third parties (including but not limited to Google, YouTube, Facebook and Twitter) whose content may appear on Our Site may use third party Cookies, as detailed below in section 13. Please refer to section 13 for more information on controlling Cookies. Please note that We do not control the activities of such third parties, nor the data they collect and use and advise you to check the privacy policies of any such third parties. D.5 You have the right to withdraw your consent to Us using your personal data at any time, and to request that We delete it.

D.6 We do not keep your personal data for any longer than is necessary in light of the reason(s) for which it was first collected. Personal data will be stored for no more than 10 years unless you have created an Account, if you create an Account your data will be stored until such a time as you close the Account and then for no more than 10 years afterwards.

E. How and Where Do We Store Your Data?

E.1 We only keep your personal data for as long as We need to in order to use it as described above in section 6, and/or for as long as We have your permission to keep it.

E.2 Our server is entirely based within the UK, however some of your data (for example your name and email address) may be stored outside of the European Economic Area ("the EEA") (The EEA consists of all EU member states, plus Norway, Iceland, and Liechtenstein). You are deemed to accept and agree to this by using Our Site and submitting information to Us. If We do store data outside the EEA, We will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the UK and under the GDPR including:

E.3 Data security is very important to Us, and to protect your data We have taken suitable measures to safeguard and secure data collected through Our Site.

  • Strict access limitation and logging for Our physical servers
  • Limited and heavily monitored access to Our front end systems

F. Do We Share Your Data?

F.1 We may share your data with other companies in Our group for the reasons listed in G.2 of this appendix and 6.2 above. If applicable this includes Our holding company and its subsidiaries.

F.2 We may sometimes contract with third parties to supply products and services to you on Our behalf. These may include payment processing, delivery of goods, search engine facilities, advertising, and marketing. In some cases, the third parties may require access to some or all of your data. Where any of your data is required for such a purpose, We will take all reasonable steps to ensure that your data will be handled safely, securely, and in accordance with your rights, Our obligations, and the obligations of the third party under the law.

F.3 We may compile statistics about the use of Our Site including data on traffic, usage patterns, user numbers, sales, and other information. All such data will be anonymised and will not include any personally identifying data, or any anonymised data that can be combined with other data and used to identify you. We may from time to time share such data with third parties such as prospective investors, affiliates, partners, and advertisers. Data will only be shared and used within the bounds of the law.

F.4 We may sometimes use third party data processors that are located outside of the European Economic Area ("the EEA") (The EEA consists of all EU member states, plus Norway, Iceland, and Liechtenstein). Where We transfer any personal data outside the EEA, We will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the UK and under the GDPR.

F.5 In certain circumstances, We may be legally required to share certain data held by Us, which may include your personal data, for example, where We are involved in legal proceedings, where We are complying with legal requirements, a court order, or a governmental authority.

G. What Happens If Our Charity Changes Hands?

G.1 We may, from time to time, expand or reduce Our charity and this may involve the sale and/or the transfer of control of all or part of Our business charity. Any personal data that you have provided will, where it is relevant to any part of Our business that is being transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use that data only for the same purposes for which it was originally collected by Us.

G.2 In the event that any of your data is to be transferred in such a manner, you may not be contacted in advance and informed of the changes.

H. How Can You Control Your Data?

H.1 In addition to your rights under the GDPR, set out in section 4, when you submit personal data via Our Site, you may be given options to restrict Our use of your data.
